Welcome to TheCareFitness! These Terms and Conditions outline the rules and regulations for using TheCareFitness website, programs, and services. By accessing or using our services, you agree to be bound by these Terms and Conditions. If you disagree, please refrain from using our website or services.

1. About TheCareFitness.

  • TheCareFitness is a fitness, fat loss, and health coaching company. We provide personalized coaching services to help clients achieve their fitness, fat loss, and overall health goals.
  • By enrolling in our programs, you confirm that you are at least 18 years of age or have obtained parental/guardian consent.


2. Health Disclaimer.

  • TheCareFitness provides coaching services for general health and wellness purposes. These services are not a substitute for medical advice, diagnosis, or treatment.
  • Clients are advised to consult with a healthcare provider before starting any fitness, nutrition, or fat loss program, especially if they have pre-existing medical conditions, injuries, or are pregnant.
  • Participation in any fitness program carries inherent risks, including injury or health complications. Clients assume all responsibility for their participation and waive any claims against TheCareFitness.

3. Results Disclaimer.

  • Results vary based on individual effort, consistency, adherence, and biological factors.
  • TheCareFitness does not guarantee specific outcomes, such as weight loss or muscle gain, as results depend on individual circumstances.
  • Progress tracking is based on data shared by the client (e.g., weight, body measurements, fitness levels). Clients are responsible for providing accurate and timely updates.

4. Program Customization

  • Our programs are personalized based on each client’s lifestyle, health conditions, and goals. Changes to meal or training plans will only be made when a genuine requirement arises, as determined by TheCareFitness coaches.
  • Blood tests or other diagnostic data may be requested to optimize program customization.


5. Medical Conditions

  • Clients must disclose any ongoing health issues or medical conditions before starting the program by filling out the detailed questionnaire form accurately.
  • TheCareFitness may request medical records to better understand your health and create a program tailored to your needs.
  • The information provided will be reviewed to determine if our program is suitable for you. If your condition makes it impossible for you to participate in the program, TheCareFitness reserves the right to issue a refund before the program begins.
  • If adjustments to the program are required due to your health needs, we will inform you before starting. You may then decide whether to proceed with the program.
  • It is essential that all relevant health information is disclosed upfront. If a health issue requiring special care comes to light after the program has begun and was not disclosed initially, no refunds will be provided if you are unable to follow the new plan.

6. Client Responsibilities & Plan Upgradation.

  1. Client Responsibilities
  • Clients agree to:
    • Provide accurate and complete information during the onboarding process.
    • Follow the program instructions and report any injuries, illnesses, or other health concerns to TheCareFitness promptly.
    • Adhere to the rescheduling and session attendance policies. Missed sessions are subject to rescheduling limits, as per program terms.
  • Failure to comply with these responsibilities may impact program results.
  1.  Plan Upgradation
  • If you start with our 100-day program, you can upgrade to the 365-day plan within the first 30 days.
  • This option is available only during the initial 30-day period of your current program.
  • To switch plans, you must pay the price difference between your current plan and the longer one you choose.
  • After completing 30 days of your program, this upgrade option will no longer be available.


C. Transfer of Programs

  • Our coaching services are non-transferable and cannot be assigned to family members, friends, or colleagues under any circumstances.
  • Each program is personalized and designed specifically for the enrolled individual, and sharing or transferring the service is strictly prohibited.


7. Payment and Refund Policy

  • All payments made to TheCareFitness are non-refundable.
  • Program extensions, pauses, or adjustments will be provided only in genuine cases, such as medical emergencies, at the discretion of TheCareFitness.


8. Progress Tracking

  • Progress is tracked through various methods, including weight measurements, fitness assessments, and client-reported data.
  • Regular updates and adherence to the plan are necessary for accurate progress tracking.



9. Training Session Recordings

  • Some training sessions may be recorded for quality improvement, feedback, or progress tracking purposes. Clients will be informed about recordings in advance and may choose to opt out if they prefer.
  • If a client opts out of session recordings, TheCareFitness will not be held responsible for any miscommunication, disputes, or inappropriate behavior that may occur during unrecorded sessions.
  • All recordings will be handled with confidentiality and used exclusively for internal purposes to enhance service quality.
  • Any form of misconduct or abusive behavior by the client towards the training coach during a session will result in immediate termination of the client’s plan, without any refund.

10. Privacy and Confidentiality

  • TheCareFitness is committed to protecting your privacy. All personal information, including health and fitness data, will be kept confidential and used only for program purposes.
  • Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.

11. Third-Party Products and Services

  • TheCareFitness may recommend third-party products or services, such as fitness equipment or supplements. These recommendations are optional, and TheCareFitness is not responsible for the quality, effectiveness, or safety of these products or services.

12. Termination of Services

  • TheCareFitness reserves the right to terminate services for clients who:
    • Violate these Terms and Conditions.
    • Fail to make required payments.
    • Engage in behavior that is abusive, inappropriate, or harmful.

13. Limitation of Liability

  • TheCareFitness, its founders, employees, or affiliates are not liable for injuries, health issues, or damages arising from participation in fitness programs.
  • By enrolling in our programs, you agree to assume all risks associated with fitness activities, including but not limited to physical injuries, health complications, or adverse reactions.
  • You agree to indemnify and hold harmless Prakash Sau and TheCareFitness against any claims, liabilities, or expenses arising from health conditions or injuries during or after participation in the program.


14. Modification of Terms

  • TheCareFitness reserves the right to update these Terms and Conditions at any time. Changes will be effective upon posting on our website. Continued use of the website or services indicates acceptance of the revised terms.

15. Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms and Conditions will be subject to the exclusive jurisdiction of the courts located in Jodhpur, Rajasthan.
